Business Torts

As attorneys, we know that unethical dealings can surface in almost any business setting. When unscrupulous behavior rises to the level of illegality, it can likely be classified as a business tort. For example, fraud can unfortunately arise in a variety of arenas, including real estate, health care, government contracts and business transactions generally. Fraud can be associated with deceitfully inducing another person or entity into entering a contract by means of false information, by withholding information or with the intention of never performing the contract. The term “deceit” applies to any act done to induce someone to make a decision to his or her detriment, and includes:

  • Negligent Misrepresentation
  • Intentional Misrepresentation
  • Concealment of Facts
  • False Promises

At Maloney and Maloney, we are able to identify potentially fraudulent or deceitful actions and successfully prosecute them. We also deal with claims of interference with business dealings or contracts, often referred to as “tortious interference” claims. Texas recognizes many types of tortuous interference claims, including tortious interference with contractual relationships; tortious interference with prospective contractual relationships; and, tortious interference with business relationships.

A successful plaintiff in a claim for tortious interference may recover both actual and punitive damages.
